How we approach it
Frequently asked questions
Who files FC-TRS — buyer or seller?
The resident party to the transaction is generally responsible for reporting.
When is it due?
Within 60 days of the transfer of shares or of remittance, as applicable.
Is FC-TRS needed for resident-to-resident transfers?
No — it applies only to transfers involving a non-resident.
Does FC-TRS apply to transfer of shares by way of gift?
Transfers by gift to or from a non-resident generally have separate reporting and RBI approval requirements rather than standard FC-TRS — we assess this specifically.
What if the transfer price doesn't match FEMA pricing guidelines?
A mismatch can attract scrutiny or require compounding to regularise; we check pricing compliance before the transfer is executed, not just at filing stage.
Is FC-TRS required for transfer of LLP contribution?
Yes, transfer of capital contribution or profit share in an LLP involving a non-resident has an equivalent reporting requirement under FEMA.
